1. Service Overview

We provide guided boat tour experiences along the beautiful coast of Portimão, Portugal, including visits to the famous Benagil Cave and other stunning coastal attractions. Our tours are operated from Clube Naval De Portimão, 8500-702 Portimão, Portugal.

2. Booking and Payment

2.1 Booking Process

• All bookings must be made through our authorized booking channels
• Bookings are subject to availability and weather conditions
• We accept bookings up to 30 minutes before departure time
• Full payment is required at the time of booking unless otherwise specified

2.2 Payment Terms

• We accept major credit cards, debit cards, and other payment methods as specified
• All prices are in Euros (EUR) unless otherwise stated
• Prices include all applicable taxes
• Payment confirmation serves as your booking receipt

3. Cancellation and Refund Policy

3.1 Customer Cancellations

• 24+ hours before departure: Full refund or rescheduling
• 12-24 hours before departure: 50% refund or rescheduling fee applies
• Less than 12 hours: No refund, but may reschedule subject to availability
• No-show: No refund or rescheduling

3.2 Weather Cancellations

• Tours may be cancelled due to adverse weather conditions for safety reasons
• Weather-related cancellations by us result in full refund or free rescheduling
• Weather decisions are made at our sole discretion based on safety assessments

4. Safety Requirements and Passenger Obligations

4.1 Arrival and Check-in

• Passengers must arrive at least 15 minutes before departure time
• Valid identification may be required for check-in
• Late arrivals may result in tour forfeiture without refund

4.2 Safety Compliance

• All passengers must follow safety instructions provided by crew members
• Life jackets must be worn when required and properly fastened
• Passengers must remain seated while the boat is in motion unless otherwise instructed
• Swimming is only permitted in designated areas and with crew approval

4.3 Prohibited Items and Behavior

• Excessive alcohol consumption before or during the tour
• Illegal substances or weapons
• Disruptive or dangerous behavior
• Smoking on board (designated areas only, if applicable)

5. Age Restrictions and Special Requirements

• Children under 3 years are not permitted on tours for safety reasons
• Children aged 3-12 must be accompanied by adults and wear life jackets at all times
• Pregnant women should consult their physician before booking
• Passengers with mobility issues should inform us at booking for appropriate arrangements
• Maximum capacity per tour is strictly enforced for safety

6. Liability and Insurance

6.1 Our Liability

• We maintain comprehensive insurance coverage for our operations
• Our liability is limited to the extent permitted by Portuguese law
• We are not liable for personal belongings lost or damaged during tours
• Participation in tours is at passenger's own risk

6.2 Passenger Responsibility

• Passengers are responsible for their own safety and following instructions
• Medical conditions that could affect safety must be disclosed
• Travel insurance is recommended but not required
• Passengers liable for any damage caused by their actions

7. Photography and Media

• We may take photographs and videos during tours for promotional purposes
• By participating, you consent to being photographed/filmed
• Photos may be used on our website, social media, and marketing materials
• Please inform crew if you prefer not to be photographed

8. Force Majeure

We are not liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to:

• Severe weather conditions
• Natural disasters
• Government restrictions or regulations
• Port closures or marine authority restrictions
• Technical failures or equipment breakdown

9. Data Protection and Privacy

Your personal information is collected and processed in accordance with our Privacy Policy and applicable data protection laws. By using our services, you acknowledge that you have read and understood our Privacy Policy.

10. Modifications to Service

• We reserve the right to modify tour routes due to weather, safety, or other operational reasons
• Alternative routes of equal value will be provided when possible
• Tour duration may vary due to weather and sea conditions
• No refunds for minor itinerary changes made for safety reasons

11. Intellectual Property

• All content on our website is protected by intellectual property rights
• Unauthorized use, reproduction, or distribution is prohibited
• Company logos, trademarks, and branding are our exclusive property

12. Governing Law and Jurisdiction

These Terms are governed by Portuguese law. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Portugal.
